Všeobecné obchodní podmínky

Tyto všeobecné obchodní podmínky (dále jen „Podmínky“) upravují práva a povinnosti mezi pořadatelem jednodenních výletů Výletek (dále jen „Pořadatel“) a účastníky výletů (dále jen „Účastník“)

1. Pořadatel

2. Vznik smluvního vztahu

Smluvní vztah mezi Pořadatelem a Účastníkem vzniká na základě závazné přihlášky (vyplnění online formuláře, e-mailová nebo telefonická objednávka) a úhrady celé ceny výletu.

Pořadatel následně zašle potvrzení o přihlášce a pokyny k dopravě. Tímto okamžikem je smlouva uzavřena.

Odesláním přihlášky Účastník potvrzuje, že se seznámil s těmito Podmínkami a souhlasí s nimi.

3. Účast na výletu

Účast na výletu je na vlastní odpovědnost.

Účastníci mladší 18 let se mohou zúčastnit pouze v doprovodu dospělé osoby.

Účastník je povinen mít platný cestovní doklad (u zahraničních výletů občanský průkaz nebo pas).

Účastník je povinen dodržovat předpisy navštívené země a řídit se pokyny průvodce.

4. Cena a platební podmínky

Cena výletu je uvedena u konkrétní nabídky na webu Výletku.

Cena zahrnuje služby specifikované v popisu výletu (např. doprava, služby průvodce).

Cena nezahrnuje služby výslovně neuvedené (např. vstupy do památek, občerstvení, cestovní pojištění).

Cena je splatná předem, a to převodem na účet Pořadatele nejpozději do data uvedeného v potvrzení přihlášky.

5. Změny programu a zrušení výletu pořadatelem

Pořadatel si vyhrazuje právo provést změny programu, času odjezdu nebo trasy z důvodu nepředvídatelných okolností (např. počasí, dopravní situace, rozhodnutí úřadů, vyšší moc).

O změně bude Účastník informován e-mailem nebo telefonicky bez zbytečného odkladu.

Pořadatel je oprávněn výlet zrušit při nízkém počtu přihlášených účastníků nebo z jiných vážných důvodů. V takovém případě vrací Účastníkovi 100 % uhrazené ceny.

6. Storno podmínky (zrušení ze strany účastníka)

Účastník může výlet zrušit pouze písemně (e-mailem). Rozhoduje datum doručení storna.

Storno poplatky:

• více než 14 dní před výletem – vrací se 100 % ceny,

• 7–14 dní před výletem – vrací se 50 % ceny,

• méně než 7 dní před výletem – cena se nevrací.

Pokud se Účastník nedostaví na místo odjezdu nebo výlet zmešká, nemá nárok na vrácení ceny.

Účastník může za sebe vyslat náhradníka, pokud o tom Pořadatele informuje nejpozději 24 hodin před odjezdem.

7. Práva a povinnosti účastníků

Účastník má právo:

• na služby v rozsahu uvedeném v nabídce,

• na reklamaci vad poskytnutých služeb,

• na vrácení ceny při zrušení výletu ze strany Pořadatele.

Účastník je povinen:

• řídit se pokyny Pořadatele a průvodce,

• dostavit se včas na místo odjezdu,

• dodržovat právní předpisy a nerušit průběh výletu,

• uhradit škody, které způsobí sobě, Pořadateli nebo třetím osobám.

8. Reklamace

Pokud má Účastník výhrady k průběhu výletu, je povinen oznámit je bezodkladně průvodci, aby mohla být sjednána náprava na místě.

Reklamace je dále nutné uplatnit písemně na e-mail Pořadatele nejpozději do 14 dnů od konání výletu.

Pořadatel je povinen reklamaci vyřídit do 30 dnů od jejího obdržení.

9. Odpovědnost a pojištění

Pořadatel odpovídá za řádné zajištění služeb uvedených v nabídce.

Pořadatel nenese odpovědnost za škody způsobené vyšší mocí (např. přírodní události, stávky, rozhodnutí úřadů), třetí osobou nebo samotným Účastníkem.

Účastník je povinen zajistit si vlastní cestovní pojištění, zejména u zahraničních výletů. Pořadatel cestovní pojištění nezajišťuje, pokud není výslovně uvedeno jinak.

10. Ochrana osobních údajů

Pořadatel zpracovává osobní údaje Účastníků pouze v rozsahu nezbytném pro organizaci výletu.

Osobní údaje jsou uchovávány po dobu 3 let od konání výletu a nejsou poskytovány třetím osobám, s výjimkou nezbytných partnerů (např. dopravce).

Účastník má právo na přístup ke svým údajům, jejich opravu a výmaz v souladu s GDPR.

Osobní údaje nebudou použity k marketingovým účelům bez předchozího souhlasu Účastníka.

11. Závěrečná ustanovení

Tyto Podmínky se řídí právním řádem České republiky.

Jsou platné od 29.9. 2025 a vztahují se na všechny výlety organizované Výletkem a společností Pagusa s.r.o.

General Terms and Conditions

Výletek (Pagusa s.r.o.)

These General Terms and Conditions (hereinafter referred to as the “Terms”) govern the rights and obligations between the organizer of one-day trips Pagusa s.r.o., operating under the brand Výletek (hereinafter referred to as the “Organizer”), and the participants of trips (hereinafter referred to as the “Participant”).

2. Formation of the Contractual Relationship

The contractual relationship between the Organizer and the Participant is established upon the submission of a binding application (online form, e-mail, or telephone order) and payment of the full trip price.

The Organizer subsequently confirms the application and provides travel instructions. At this point, the contract is concluded.

By submitting the application, the Participant confirms that they have read and agreed to these Terms.

3. Participation in the Trip

Participation in the trip is at the Participant’s own risk.

Participants under 18 years may only join if accompanied by an adult.

The Participant must have valid travel documents (ID card or passport for trips abroad).

The Participant is required to comply with the legal regulations of the visited country and follow the guide’s instructions.

4. Price and Payment Conditions

The price of the trip is stated in the specific offer on the Výletek website.

The price includes services specified in the trip description (e.g., transport, guide services).

The price does not include services not explicitly stated (e.g., entrance fees, meals, travel insurance).

The price must be paid in advance, by bank transfer, no later than the date specified in the confirmation.

5. Program Changes and Cancellation by the Organizer

The Organizer reserves the right to change the program, departure time, or route due to unforeseen circumstances (e.g., weather, traffic situation, government decisions, force majeure).

Participants will be informed of changes by e-mail or phone without undue delay.

The Organizer may cancel the trip if the minimum number of participants is not reached or for other serious reasons. In such case, 100% of the paid price will be refunded.

6. Cancellation by the Participant

The Participant may cancel participation only in writing (by e-mail). The date of delivery is decisive.

Cancellation fees:

• more than 14 days before the trip – 100% refund,

• 7–14 days before the trip – 50% refund,

• less than 7 days before the trip – no refund.

If the Participant fails to arrive at the departure point or misses the trip, no refund will be provided.

The Participant may nominate a substitute if the Organizer is informed at least 24 hours before departure.

7. Rights and Obligations of Participants

The Participant has the right:

• to services as stated in the trip offer,

• to file a complaint about defective services,

• to a refund if the trip is cancelled by the Organizer.

The Participant is obliged:

• to follow the instructions of the Organizer and guide,

• to arrive on time at the departure point,

• to comply with legal regulations and not disturb the trip,

• to compensate for any damages they cause to themselves, the Organizer, or third parties.

8. Complaints

If the Participant has any objections during the trip, they must inform the guide immediately so that the issue can be resolved on the spot.

Complaints must also be submitted in writing by e-mail no later than 14 days after the trip.

The Organizer is obliged to handle the complaint within 30 days of receipt.

9. Liability and Insurance

The Organizer is responsible for ensuring the proper provision of services stated in the offer.

The Organizer is not liable for damages caused by force majeure (e.g., natural events, strikes, government restrictions), third parties, or the Participant themselves.

Participants are required to arrange their own travel insurance, especially for trips abroad. The Organizer does not provide travel insurance unless explicitly stated otherwise.

10. Personal Data Protection

The Organizer processes personal data of Participants only to the extent necessary for organizing the trip.

Personal data is stored for 3 years after the trip and is not provided to third parties, except for necessary partners (e.g., transport providers).

The Participant has the right to access, correct, or delete their personal data in accordance with GDPR.

Personal data will not be used for marketing purposes without the Participant’s prior consent.

11. Final Provisions

These Terms are governed by the laws of the Czech Republic.

They are valid from 29.9. 2025 and apply to all trips organized by Pagusa s.r.o. under the brand Výletek.
